Kalyan Molestation Case: JMFC Court Sentences 29-Year-Old Man To 1-Yr Jail In Just 35 Days; Chargesheet Filed Within 7 Hours Of FIR

Thane: The Kalyan JMFC Court has sentenced a 29-year-old man to one year of imprisonment in a molestation case, with the entire trial concluded in just 35 days. Notably, the chargesheet was filed within seven hours of the FIR registration.

The accused has been identified as Omkar Nikalje, a resident of Wadala, Mumbai. The incident occurred on June 3 at around 7:40 AM, when Nikalje allegedly trespassed into the residence of a 34-year-old woman in Kalyan and molested her.

According to the police, the victim’s brother-in-law had left for work early that morning and inadvertently left the door slightly ajar. Taking advantage of the situation, the accused entered the house while the woman, her husband, and children were asleep.

He allegedly roamed inside the house and touched the victim inappropriately. She immediately raised an alarm, waking her husband. Although the accused fled the scene, locals managed to apprehend him shortly after.

The victim, accompanied by her husband, approached the Khadakpada Police Station around 10:00 AM. The police promptly registered an FIR and swung into action — conducting a spot panchnama, collecting CCTV footage, and recording statements of witnesses, including an eyewitness.

The FIR was registered the same day under Section 74 (Assault or use of criminal force on a woman with intent to outrage her modesty) and Section 329(3) (Criminal trespass) of the Bharatiya Nyaya Sanhita (BNS). The chargesheet, consisting of 29 pages and three witness statements, was filed the same day.

The case was heard by Magistrate Aarti Shinde of the Judicial Magistrate First Class (JMFC), Kalyan, who pronounced the conviction on July 8. The court sentenced Nikalje to one year of imprisonment under Section 74 BNS and one month under Section 329(3), along with a fine of ₹5,000, of which ₹2,500 was awarded to the complainant and the remainder deposited in the government treasury.

Public Prosecutor Prakash Sapkale presented a strong case, ensuring swift justice in a rare example of speedy legal proceedings.
